Advertiser Terms
Draft for legal review. The owner fills in the bracketed details before publishing. These terms govern the placement of advertisers' offers in the ThanklyClub network.
Parties and subject matter
The network is operated by [Legal entity], [Address], registration number [Registration number] ("ThanklyClub"). The advertiser is a company that places offers for new customers (the "offer").
ThanklyClub shows offers to online store shoppers after an order is paid: on the thank-you page and in the order confirmation email. The advertiser pays for the new customers these impressions bring in.
Payment model
- The advertiser pays only for a new customer. What counts as a new customer (a sign-up, a first purchase, a paid subscription) is fixed for each offer at onboarding.
- Impressions and clicks are not charged.
- The payout amount, countries, and attribution window are agreed individually and recorded in [Schedule / insertion order].
- Invoices are issued [frequency] for confirmed conversions. Payment is due within [Payment term] days.
Incentivized traffic
An offer is shown to the shopper as a gift or a bonus with their order. By connecting an offer, the advertiser accepts that this is incentivized traffic and confirms that this format is permitted for its program.
Tracking and conversion verification
- On a click, ThanklyClub redirects the shopper to the advertiser's URL and adds a sub parameter with the click ID.
- The advertiser reports a conversion by postback with this sub, an amount, and a status: pending, approved, or rejected.
- The advertiser verifies a conversion within 14–30 days [exact period per offer]. If the status is not changed within that period, the conversion is treated as approved [to confirm].
- A rejection must be justified: duplicate, cancellation, refund, or fraud. On request, the advertiser states the reason.
Offer requirements
- The offer must be real and deliverable: a trial, discount, or bonus, with clear conditions in the terms field.
- Texts and images must be lawful, free of misleading claims, and in the language of the country where they are shown.
- Betting and gambling, crypto trading, loans and credit, tobacco and vaping, and adult content are not accepted.
- Banks and payment apps, insurance, supplements, alcohol, and dating are accepted but shown only in stores that have enabled these categories themselves.
- ThanklyClub may reject or remove an offer that breaks these requirements or if shopper complaints point to a problem.
Where an offer is shown
An offer is shown in stores where its category is enabled and does not compete with the store's range. A store can block the advertiser's domain. ThanklyClub does not guarantee placement in specific stores or any particular volume of impressions.
Data
ThanklyClub does not pass shoppers' personal data to the advertiser. The advertiser receives only a click identifier. Data that a shopper leaves on the advertiser's site is processed by the advertiser as an independent controller, under its own rules and in compliance with the GDPR.
Anti-fraud
ThanklyClub limits the number of counted clicks per offer from one order and checks events for signs of inflation. If the advertiser finds suspicious traffic, it reports this to [Email for advertisers] with the click IDs.
Liability and termination
The advertiser is responsible for its goods and services, for the offer's compliance with the law, and for delivering what was promised to the shopper. Either party may suspend an offer by giving the other [Notice period] days' notice; conversions confirmed before then are paid.
